Welcome to Baked Desires Marketplace, the online marketplace to buy and sell sweet postal bakes. By using our site, you agree to our terms and conditions. Read on to learn more about our policies for bakers and customers, including information on shipping and more.

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://bakeddesires.co.uk website (the “Service”) operated by Baked Desires (“us”, “we”, or “our”).

Baked Desires (“us”, “we”, or “our”) operates the Baked Desires website (the “website”, “service”). Specifically, we use this website to facilitate trades between bakers and customers.

By ordering your bespoke baked products from Baked Desires (or accessing our services and website), you agree to be bounded by these Terms & Conditions and all other policies on Baked Desires. You also agree that Baked Desires is a marketplace and therefore, is not responsible or liable for all contents posted on the website. These details are important for us all as they set out what we expect from each other, and they also give you helpful information. Of course, if you need anything else, get in touch with us – we always love to hear from you!

We keep these terms updated and we amend them often, so remember to check back in before you shop, as the latest set will always apply.

About you

To shop at Baked Desires, you need to:
• be at least 18 years old;
• have a credit or debit card that we accept; and
• be authorised to use that credit or debit card (e.g. it is in your name or you have permission to use it).

When making an order

We require payments to be able to guarantee your orders, and without this, your baker cannot make your bespoke order. When you place an order, you should receive an acknowledgement e-mail confirming receipt of your order. We then carry out a standard pre-authorisation check to make sure there is enough money on the card.

We only accept your order once payment has been approved and we have debited the payment card (and then the contract is made based on these terms).

You may be able to cancel (not change) your order within a short period of ordering – timings depend on your chosen delivery method (and will be set out in the acknowledgement email). You cannot change your order – you’ll need to cancel and re-order. Please note that we will not be able to cancel your order after some time once your baker has started the process of creating your baked desires due to the bespoke nature of each of your chosen baker’s creations. Because all the items on Baked Desires are bespoke and made specially for you by your chosen baker, your baker may have had to turn others away in order to accommodate your order. This means you will not be entitled to refunds in the event of cancellation or postponement, depending on the timelines to delivery. We reserve the right to review this on a case-by-case basis.

All orders are subject to availability and confirmation of the order price. Don’t worry, if there’s an issue with an order, we will get in touch with you immediately.

Very occasionally, we may need to refuse or cancel an order or close or freeze an account (even if we have previously confirmed your order) – e.g. if we think there’s something dodgy going on with an order or an account. If this happens to you and you think we’ve made a mistake, please don’t take offence – get in touch with us and we will be happy to speak to you about it. At all times, we reserve the right to cancel any order still awaiting final payment confirmations on the delivery date without notice.

Allergy and dietary details

When bakers set up their stores with us, they would usually include what they have to offer on their store pages and provide details of ingredients for each product. We encourage you to always read the ingredients and allergy information provided with any product before purchasing it. If you have any questions or concerns about food allergies and any other dietary requirements, you should always contact us or the baker directly before completing your order.

Baked Desires do not possess any products sold through the website and are not involved in the baking process. Each Seller is responsible for the listing and baking of products. As such, we have no control over, and do not guarantee the existence, quality, safety or legality of any aspect of the items listed, and the truth or accuracy of the listings.

Voucher Codes

From time to time, we may give you promotion codes that you can use to reduce the price of specified products in our store. Remember, it is up to you to enter the code at checkout!

If you’re given a unique Voucher Code that is meant just for you (e.g. a student code), please keep it secret and do not let anyone else use it or abuse it (e.g. don’t post it on social media). If we think there is or has been misuse of it in any way (e.g. selling it or sharing it with others), we reserve the right to cancel it and/or suspend or even close your account without telling you.

We don’t like to do this, but if a promotion can’t run properly because someone or something is spoiling the fun for everyone – e.g. fraud, tampering, technical errors or anything else that is beyond our control that affects the running or fairness of the promotion – we can cancel, modify or suspend the promotion code.

Prices and product descriptions

There’s a lot going on here at Baked Desires and from time to time, our bakers may price up or describe a product or promo wrongly. If an error is discovered for any baked desires you have ordered, we will tell you as soon as possible and give you the option of reconfirming your order (at the correct price) or cancelling it.

If we are unable to get in touch with you, we will treat the order as cancelled. If you cancel and you have already paid, we will refund you in full.

You should note that the prices shown will include VAT (where applicable).

Depending on the value of your order or the delivery option or address you choose, delivery costs may also be charged (see below). Such additional charges will be clearly shown during the checkout process and included in the ‘Total Cost’.

Shipping & Delivery

Before you finalise your order, you’ll be given various delivery options to choose from with estimated delivery dates depending on the delivery address.

For orders chosen for delivery, deliveries are made by hand on the date specified in your order. Please ensure someone is available at the delivery address on the day of your order. If there is no one on hand to receive the order, your delivery driver will do their utmost best to leave them in a safe place (with a neighbour, receptionist, caretaker etc.).

All delivery drivers are instructed in the correct handling of the order and will always pass this information on to any post room workers. As these are all edible items that are best enjoyed when fresh, we ask that you pay close attention to delivery so that you can receive it in the form that you have ordered it. Once the products have been delivered and signed for, it is assumed to be in your care, and we will not accept liability for the subsequent handling of your baked desires.

In the case that the delivery driver is left with no choice, they will leave your order at the address you have given us as re deliveries are not possible given the bespoke nature of the baked desires. If you would like your baked desire to be delivered to your place of work or somewhere with a mail room/courier point, that is possible, but please be aware that Baked Desires cannot accept any liability for the treatment of your order or mishandling once a delivery has been made.

Your baker will always work very hard to try to meet all delivery times but sometimes there may be delays – e.g. because of carrier delays, logistics or bad weather. We will keep you updated as much as we can if this becomes the case.

Returns, refunds & exchanges

Unfortunately, we cannot accept returns for full refund as we are all about personalisation, in order words, all desires are baked to order. All our Baked Desires bakers work their socks off to bake and create your perfect desire, made for you to deliciously indulge in. Every single order is specially crafted and bespoke. The freshly baked nature of all the desires also means that no one else can have it and it becomes a waste if you refuse it. Once our bakers start the process of making your baked desire, we are unable to cancel it. You are so important, and our bakers know that. Part of this is that your orders are freshly made to perfection. This would usually start from your baker sourcing and paying for the highest quality ingredients. Therefore, we are also unable to accept returns or exchange.

We hope your bakers can always get it right but the human in us may sometimes make that impossible. If you are unhappy with your order, we will review on a case-by-case basis and are able to offer vouchers, replacements, or refunds in exceptional cases where you might have received an incorrect or incomplete order for instance. If that is the case or if you are in any way unhappy with your baked desire upon arrival you must contact us within 24 hours of receiving your order. Baked Desires will not accept liability for any complaints made after this time.. This is our promise to you as we know your item cannot be returned for a refund once your bakers start their sourcing and ingredient purchase i.e even before you receive it. Just make sure you let us know within 24hrs from when it is delivered.

This doesn’t affect your statutory rights.

If you need to change the date or details of your order or cancel it altogether, please contact us as early as possible. Orders cancelled at least 7 days to delivery will receive full refund, orders cancelled 2-7 days will receive 50%, and orders cancelled less than 48hrs to delivery will not be entitled to refunds. In any case, let us know and we will always do our best in all cases. Refunds, replacements and vouchers remain at the discretion on Baked Desires.

Our right to suspend or cancel your registration

Baked Desires may suspend or cancel your account immediately at our reasonable discretion or if you breach any of your obligations under these Terms & Conditions.

The suspension or cancellation of your registration and your right to use the website shall not affect either party’s rights or liabilities.

Availability of the website

Although Baked Desires aims to offer you the best service possible, we make no promise that the services on our website will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, you should report it to us or by email at hello@bakeddesires.co.uk and we will attempt to correct the fault as soon as we reasonably can.

Further, your access to the website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Baked Desires will attempt to restore the service as soon as it reasonably can. That said, we will never be held liable if the service is unavailable at any time for any reason.

Marketing

We reserve the right to use photographs of the bakers and orders on Baked Desires for marketing purposes. We fully respect your privacy, so please let us know if you would rather not want us to use these photos as it relates to you.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

Your information

Our Privacy Policy sets out how we will use your information. If your details change, remember that you need to update My Account so we can continue giving you our best service (you can also update your marketing preferences there).

At Baked Desires, we are stepping up to be able to interact with and chat to you through social media. However, we cannot control those social media platforms or how you set your profiles on them. Please check and set your privacy settings so that you understand and are comfortable with how your personal information on those platforms will be used.

Please do not do the following

We know it’s obvious, but you must not misuse or tamper with our websites, apps or other services (“websites”) (e.g. hack, introduce viruses, trojans, worms, logic bombs or other technologically harmful material or carry out denial of service attacks etc) or otherwise mess with our technology or functionality or steal our or our customers’ data. Doing any of these things may be a criminal offence, but they also get in the way of us giving our loyal customers the best service, so we take them really seriously. We will report any such breach or activity (and all information about the people carrying it out) to the relevant law enforcement authorities.

We recommend you use virus protection software when using any website, including ours. Although we have a dedicated team who work restlessly to stop people from messing with our website, we cannot guarantee that it will always be secure from bugs, viruses or troublemakers.

Oh, and you are not allowed to use automated systems or software to extract data from our website (AKA ‘screen scraping’).

Take note: you agree to indemnify, defend and hold harmless Baked Desires, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this website or your breach of the Terms and Conditions.

Linking to this Website

It is fine for you to link to Baked Desires, as long as you do so in a way that is not commercial, is fair and legal, and does not damage or take advantage of our reputation.

Please do not link in a way that suggests any form of approval or endorsement by Baked Desires where none exists.

Our website must not be framed on any other site without our permission.

Complaints or need to speak to our customer service?

Occasionally things do go wrong, and you may want to get in touch with us. If that happens, please contact us here or give us a shout at hello@bakeddesires.co.uk.

We are confident that we will be able to resolve your complaint to your satisfaction.

Legal stuff

We have the right to amend, remove or vary our services and/or any part of the website (including this T&Cs) at any time.

These terms and our dealings with you are subject to English law and the exclusive jurisdiction of the English courts.

User Generated Content

Have we reached out to you on social media to feature your content on our social media channels? Congrats! It means we love your bakes.

By giving you the opportunity to feature your content on our social media channels and by responding with the required hashtag (such as #bakeddesires, #baked_desires, etc) you agree:

  • we can use your handle and the content (the “content”) on Baked Desires or on our social media platforms.
  • we can edit, crop, adapt, enhance, or modify the Content (but we promise not to treat you in a derogatory manner).

You promise that you:

  • have the permission of everyone in the content;
  • have the right to grant Baked Desires the above rights; and
  • are at least 18.

If you (or anyone in the content) asks us to remove the content, we will remove the content from the social media accounts that we control.

You understand that other users of these social media platforms can also share and make use of the content once posted.  In particular, a user of these platforms can take a screenshot of and save an image of the content to their device, share the content on social media platforms or websites which feature the content (and sharing capabilities). If you do not want to grant the permissions set out above, then please do not give us consent to use the content.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Baked Desires and its licensors.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
